ANKARA — Şaban Kaygusuz, a disabled prisoner missing one hand and one leg, has been released from prison.
Kaygusuz, who had been held at Kayseri Bünyan No. 2 T-Type Closed Prison and is missing his right hand and right leg, was released following a ruling on the suspension of his sentence. Multiple applications had been filed seeking a postponement of his sentence, and he was most recently referred to the Forensic Medicine Institute (ATK) three weeks ago.
It was learned that the ATK ruled that he was unfit to remain in prison and recommended that his sentence be deferred for one year. Following this decision, Kaygusuz was released by order of the Office of Judge of Execution.
ABOUT SABAN KAYGUSUZ
Kaygusuz was born in 1996 in Bilgili village in Dihê (Eruh) district of Sêrt (Siirt). Kaygusuz's family was forced to migrate to Dîlok (Antep) the same year due to the imposition of village guards. Kaygusuz joined the PKK in 2015. In 2017, he was wounded in a clash in Şirnex (Şırnak). Kaygusuz was transferred to a hospital in Wan, but before his treatment was completed, he was arrested, wounded and put in Siirt Prison. Kaygusuz was transferred to Diyarbakır Type D Prison and on October 19, 2021, and then he was transferred to Kayseri Bünyan Type T Closed Prison No 1 on the grounds of “security”. Kayseri Education and Research Hospital issued a 90 percent disability report due to he is missing his right hand and right foot. Despite this, Kaygusuz was given a “can stay in prison” report on December 8, 2022.
Kaygusuz was referred to the ATK again on 12 June 2024. The Third Expert Committee, which prepared a report on Kaygusuz following his examination, issued a decision differing from its previous ruling that he “cannot sustain his life independently under prison conditions”. In the decision dated 7 August, the following statements were made regarding Kaygusuz’s condition: “He does not have a chronic illness; his condition constitutes a disability; and it does not constitute a state of incapacity.”
