The objection made on Tunç case was denied 2019-02-12 14:17:49 ŞIRNAK- The objection to the ve non-prosecution decision about Orhan Tunç's investigation file who was killed during the curfews in Cizre was rejected. The application on behalf of the ECtHR, was also rejected.    A non-prosecution decision was given by the Şırnak Chief Prosecutor's Office for the case of Orhan Tunç, brother of Cizre People's Assembly Co-chair Mehmet Tunç who was killed because he was  trapped inside the basement of his apartment because of the curfew declared in Cizre in December 14,2015 and the police did not allow the ambulance to pass through and pick him up. Even though the European Court of Human's Rights (AİHM) issued an injunction on the case, the verdict was based on the law being in accordance with the facts.   According to the information obtained the judge who evaluated the objection passed his verdict of rejection a while ago.   Following the rejection of the file, the attorneys appealed to the Constitutional Court (AYM).   The ECHR also rejected the application made on behalf of Orhan Tunç on the grounds that, domestic remedies were not exhausted yet.
