4 prosecutors not investigate the perpetrators, but terrorize the killed family

	URFA - It has been revealed that 4 prosecutors who conducted the investigation on the murder of the father and his sons, Esvet Şenyaşar, Celal Şenyaşar and Adil Şenyaşar, who were killed by the bodyguards and relatives AKP MP İbrahim Yıldız in the Suruç district Urfa investigated where the killed family members were buried in order to prove the “connection with an [illegal] organization” instead of shedding light on the Şenyaşar family's murder.

	 

	The dispute that erupted during the election works of the Justice and Development Party (AKP) Urfa MP and MP candidate İbrahim Halil Yıldız in the district of Suruç in Turkey's southeastern province of Urfa turned into an armed attack and conflict on June 14, 2018. The dispute began when the AKP Urfa MP İbrahim Halil Yıldız and those accompanying him started to visit the shops in the district of Suruç as part of their election campaign. After the shop owner Esvet Şenyaşar ordered the group out of his shop, a quarrel erupted between the two sides.

	 

	With the escalation of the quarrel, the bodyguards of AKP MP Yıldız shot Adil Şenyaşar, the son of Esvet Şenyaşar, in his leg. After hearing that his brother had been shot, Fadıl Şenyaşar came to the shop with a weapon and opened fire on the relatives and bodyguards of Yıldız. In the armed conflict that erupted, the AKP MP Yıldız's brother Mehmet Şah Yıldız and the sons of Esvet Şenyaşar, Celal Şenyaşar and Fadıl Şenyaşar, were wounded. The wounded were taken to the hospital after this incident. Mehmet Şah Yıldız lost his life at the hospital, which he was referred to. Adil Şenyaşar and Celal Şenyaşar were killed inside the Suruç Public Hospital where they were taken for treatment. The father Esvet Şenyaşar was also attacked at the entrance to the hospital and lost his life.

	 

	'INVESTIGATION AIMS TO PROTECT YILDIZ FAMILY'

	 

	Second hearing of the Şenyaşar family's murder has been held in the Malatya 3rd Heavy Penal Court. Fadıl Şenyaşar, who has been imprisoned for 2 years within the scope of the case, was not released. Bülent Duran, one of the lawyers of the Şenyaşar family, stated that the indictment prepared by the prosecutors "aims to protect the Yıldız family". 

	 

	Duran said, "They want to separate the investigation files in order to obscure the killings in the hospital. A murder is committed. In this murder, the father and two sons of Şenyaşar family lose their lives. The incident starts at work and continues in the hospital. Murder is committed in the hospital where the governor, the district governor and the security chiefs are all present. If the murder is not prevented in a place where state officials are present then we are concerned that the judicial authority would not be able to conduct this investigation fairly."

	 

	'THE VICTIM FAMILY WAS TERRORIZED BY AKP'

	 

	Emphasizing that the trial was opened only two years after the incidents Duran thinks that the trial process is in a desperate situation. "It has been revealed that we have been right to be concerned since the very beginning, because the public was organized in such a way to hide the facts behind the murder associating the Şenyaşar family with an illegal organization," said Duran and added, "The family has been terrorized by a perception created by the President and the AKP. This is the tableau of the whole trial. The first thing they do was not to reach the witnesses. On the next day of the murder, that is, on June 15, prosecutor went to the police station and said that they could not reach any witnesses. In a place where there are hundreds of people and closed circuit camera systems, they could not detect nobody, this is what they say. These are all to make the murder remain unsolved."

	 

	PROSECUTORS: ARE THEY BURRIED NEXT TO THE ORGANIZATION MEMBERS?

	 

	Duran revealed the new details came up with the second hearing of the trial regarding the investigation of the four prosecutors working on the case: "In the investigation, Historical Traffic Search (HTS) records of Şenyaşar family were analyzed in order to link Şenyaşar family to an illegal organization. The prosecutor's office checked whether the killed members of Şenyaşar family were 'buried next to the organization members or buried in another place'. They also visited the anti-terror police branch and conducted an investigation there. This tableau seems dire. 3 members of a family have lost their lives and there is a need to gather evidence to deal with those who helped the perpetrators what we see is that they have done everything they could to terrorize the (killed) family. Clearly a poliical power has terrorized a family and protected the other family members who killed them."

	 

	TRIED TO BE TURNED IN TO AN “UNSOLVED MURDER”

	 

	The lawyer of the Şenyaşar family believes that the investigation is biased and the murder of Şenyaşar family members is tried to be “covered” and turned into an “unsolved murder” case based on the many inconsistencies in the investigation file: “Such an unlawful indictment is prepared so that in such an incident which had started in a shop and extended to an hospital where Adil and Celal Şenyaşar lost their lives as they were battered and shot with a gun, the Investigation is tried to be divided into two parts as if these are two separate incidents. The two incident constitutes a totality together. In other words, we witness that the incidents in the hospital are tried to be obscured and only the incidents in the shop are focused and exactly the incidents in the shop is served and reflected to the public. This investigation is biased. Law would never accept such a biased trial. We face a case which violates the right to a fair trial and the condition of an effective investigation."

	 

	ŞENYAŞAR FAMILY DEMANDS A FAIR TRIAL

	 

	Stating that the families in question had not known each other before the incidents Duran said, “But the Yıldız family persistently wanted to terrorize the Şenyaşar family. Şenyaşar family has been demanding a lawful and fair trial. This investigation has raised our concerns. The statements of Mehmet Şenyaşar and mother Emine Şenyaşar about the hospital and the workplace had been separated from each other. So one side of the incidents is tried to be kept confidential. Equity can not be achieved through the seperation of the investigation and the statements.  We expect a decision from the court that will address these concerns. We will continue to be with Şenyaşar family in the search for justice."
